Applications are invited for the Civil Judge (Junior Division) Judicial Magistrate (First Class) Preliminary Examination- 2010. The examination will be held in three stages i.e. Preliminary, Main & Viva-Voce. The Preliminary examination will be held on Sunday 5th September, 2010 at Aurangabad, Mumbai & Nagpur centres.

3. Pay scale :- Rs 9,000 – 14,550 plus other allowances (Total emoluments Rs. 28,800/-) (Old Pay Scale)
4. Conditions of Eligibility :- Any one of the following A, B, C, D, E or F.

A) For Advocate, Attorney or Pleader :-
Age :- As on 1st October, 2010 not less than 21 and not more than 35 years.
Qualification :- Candidate must hold a degree in law and must have practiced as an Advocate, Attorney or Pleader in the High Court or Courts
Subordinates there to for not less than 3 years on 30th June, 2010.
Note :- In the case of Public Prosecutors, their service in Maharashtra in that capacity will be taken as practice at the Bar. OR

B) For fresh Law Graduates :-
Age :- As on 1st October, 2010 not less than 21 and not more than 25 years.
Qualification :-
(i) Candidate must has secured the degree in law by passing all the examinations leading to the degree in the first attempt and,
(ii) Has secured in the final year examination of the degree in Law or in the case of candidate holding Masters Degree (L.L.M) in Law
in final year examination not less than 55 % marks. OR

C) Members of ministerial staff to the High Court OR

D) Members of ministerial staff to the Courts subordinate to High Court OR

E) Members of staff working as Legal Assistant and above in the legal section of the Law and Judiciary Department in Mantralaya. OR

F) Members of ministerial Staff of the Office of the Govt. Pleaders attached to those courts.
Age :- For C, D, E & F – As on 1st October, 2010 not less than 21 and not more than 45 years provided such employee has put in
minimum three years of service after obtaining degree in law.

5. Knowledge of Marathi :- Candidate must have sufficient knowledge of Marathi so as to enable him to speak, read and write in Marathi and
to translate with facility from Marathi into English and vice versa.
Such knowledge must be certified -
(i) In case of an Advocate, by the Principal District Judge of the District where he practices;
(ii) In case of a fresh law graduates, by principal or Head of the College or University department where the candidate was enrolled for
LL.B or LL.M.Degree.
(iii) In case of members of staff, by the head of the office under whom such candidate is working.
(iv) In special circumstances by re employment of retired Civil Judges (Junior Division).
(v) The candidates must pass Marathi language test within six months after selection as per Government Rules.

Note- Upper age limit will be relaxed :-
1) In case of B.C. candidates- up to 5 years.
2) In case of persons repatriated from erstwhile East Pakistan from 1st January, 1964 to 25th March 1971. Original Indian repatriated
from Shri Lanka after 1st November, 1964 and original Indians repatriated from Brahmadesh after 1st June 1963, up to 3 years.
3) In case of physically challenged (excluding Blind) candidates up to 45 years.
4) Blind candidates are not eligible for this posts.
6. Stages of Examination -
6.1 This Examination will be held in following three stages.
6.2 Preliminary Examination shall be consisting one question paper of objective type (multiple choice) for 100 marks. Medium of the
examination will be English.

Syllabus for Preliminary examination : -
(a) Code of Criminal Procedure. (b) Civil Procedure Code. (c) Evidence Act. (d) Transfer of Property Act.
(e) Specific Relief Act. (f) Maharashtra Rent Control Act. (g) Limitation Act. (h) Constitution of India.
(i) Indian Penal Code. (j) Law of Contracts, Sale of Goods Act & Partnership Act.
The aim of the Preliminary Examination is to Shortlist the number of candidates for main examination. Therefore in all 5
times candidates of total number of posts will be allowed to the main examination as per the merit list of the preliminary examination.
The preliminary examination being screening test its marks will not be taken into consideration for final selection and will not be
communicated to the candidates.
6.3 Main examination shall be of two hundred marks consisting two papers of 100 marks each. Medium of the examination will be
Marathi & English. Candidate who will qualify in main examination as per the qualifying standard fixed by the Commission will
be called for interview however candidates must secure fifty percent marks in each subject separately. (In case of Scheduled Caste &
Scheduled Tribe minimum marks shall be forty five percent)
6.4 Viva-Voce 50 marks. Candidate who shall obtain at least 40% marks in viva -voce shall only be considered for final selection.
6.5 The final selection shall be made on the basis of marks obtained in Main examination & Viva-Voce.
6.6 A candidate who could not successfully pass the written examination in three attempts consecutively shall be debarred from appearing for further examination.

6.7 A candidate who has committed any copying or misconduct during course of written examination or has been convicted in criminal case or is compulsorily retired, removed or dismissed from judicial service or could not successfully complete probation period of any course in judicial service shall not be eligible to appear for the Competitive Examination.
6.8 The academic qualifications & experience acquired on the date of publication of Advertisement will only be taken into account in determining the eligibility of candidates for the posts and for further selection. Academic qualifications shall be deemed to have been acquired on the date on which the result to the relevant examination has been declared by the Competent Authority.

7. Candidate selected as Civil Judge Junior Division and J.M.F.C. at the time of their appointment shall furnish Bond of Rs.2,00,000/- (Rs.Two Lakhs) that he shall work on said post for period of 3 years.

8.3 The details of post offices where application forms along with brochures for Competitive Examination are available on the Web site of the Maharashtra Public Service Commission viz.
8.4 The price of application form along with brochures is Rs. 100/-
8.5 Candidates are advised to purchase the application form along with brochures for Competitive Examination only (i.e Light Blue Colour) from designated Post Offices only.
8.6 The application form should be used at once and for one post only.
8.7 The application form along with brochures are available only in the selected post offices and arrangements for the sale is not made in the office of the Maharashtra Public Service Commission. The request for sending application form by post will not be entertained.

8.8 In case of any difficulty about availability of Application Forms, the candidate should contact to the concerned Post Master or

Maharashtra Public Service Commission’s Office on the Telephone Numbers mentioned above.

9. Fee :-
9.1 For Non B.C. Rs. 250/-
9.2 For Reserved Candidates Rs. 125/-
9.3 Fee should be paid in the Post Office by cash along with Application.
10. Place for submission of Application Form and last date for receipt of Application Form.
10.1 Application Form along with required fee will be accepted only at any of the designated Post Offices mentioned in the brochures in
their working hours on or before 29th July, 2010.
10.2 No certificates to be sent along with application form.
10.3 Application Form will not be accepted in the Office of the Maharashtra Public Service Commission under any circumstances or no
inquiry in that behalf will be entertained.
11. This Advertisement has been published as per revised Recruitment Rules and scheme of the examination. Since the terms & Conditions of eligibility for this post mentioned in the some of the previous examination brochure are based on old recruitment rule hence the provisions in the para No., 2.6.2, 2.6.3, 2.6.6 & 2.6.7 in the those brochure should be ignored.
